of Use
You must agree to the Terms and Conditions of this agreement
before you can be compensated for referring customers to India Herbs websites.
1. SPAMMING WILL NOT BE TOLERATED! Affiliates
found to be spamming via bulk email, newsgroup listings, chat room messages, or
any other means will have their accounts terminated without notice and all
commissions will be forfeit. If necessary, we will pursue legal action.
2. You may not refer yourself or your company under
your own existing account(s) and take advantage of our 2-Tier Affiliate
Program in this way. This will result in immediate termination of all your
existing account(s) without pay.

Affluent Trade Management, Inc. and you, the Affiliate,
are entering into a simple business agreement in the best interests of both
parties. The Affiliate and Affluent Trade Management, Inc. are independent
contractors, and nothing in this Agreement will create any partnership, joint
venture, agency, franchise, sales representative, or employment relationship, or
the relationship of principal and agent between the parties. All copyrighted
material and trademarked names and logos used in accordance with this Agreement
by either or both parties remain the exclusive intellectual property of the
respective originating or issuing parties. No transference of intellectual
property ownership or conveyance of rights is intended or conferred in this
Agreement. Sales and interests in this Agreement may not be transferred or sold
to any other entity and all business between the parties is subject to the terms
of this Agreement. Both parties will be held to confidence in any matters of
business with regards to this Agreement.
4. The Affiliate shall indemnify and hold
Affluent Trade Management, Inc. harmless from any and all legal actions, damages or liabilities
incurred from the day-to-day operations of the Affiliate. Under no circumstances
will Affluent Trade Management, Inc. be liable whether in tort, contract or
otherwise for indirect, incidental, consequential, special or exemplary damages
(including but not limited to damages for any loss of revenue, profits, business
interruption, loss of business information or data, loss of goodwill, work
stoppage, hardware or software failure, or other pecuniary loss) arising from or
relating to any provision of this Agreement or the program.
5.
Affluent Trade Management, Inc. will own
all right, title, and interest in and to all information that is created or
collected in the operation of the Affluent Trade Management, Inc. site and
reserves the right to amend or terminate this Agreement at any time.
6. It is the full responsibility of the
Affiliate to market these India Herbs web sites and products in a legal, ethical,
and honest fashion, and the Affiliate agrees that Affluent Trade Management,
Inc. will be held harmless from any and all actions of the Affiliate and the
Affiliate's marketing and promotional programs. Affluent Trade Management,
Inc.
reserves the right to amend all pricing plans, commissions, or conditions
relative to this agreement. Affluent Trade Management, Inc. reserves the right
to terminate any affiliate with or without cause at the sole discretion of
Affluent Trade Management, Inc. with or without notice.
7. All banners and ad materials are solely
for use to market India Herbs sites. Any unauthorized use of India Herbs banners
and ad materials will result in immediate termination of your existing account(s)
without pay.
8. Attempts to defraud us in any way will
lead to immediate termination of your existing account(s) without pay.
9. We do not accept sites that contain or
link to child pornography or other illegal activities. Doing so will lead to immediate termination of your
existing account(s) without pay.
